In order to avoid complication related to payment of the sick-pay, from the perspective of the employer, it is crucial to properly identify a sick-pay and allowance period. Employers very often have doubts in which situation they are dealing with inability to work within one allowance period, and when employer is obliged to open a new allowance period.
Incorrect determination of the allowance period may cause overpayment of the sick-pay. In such a situation the employer (if he is an entity paying the sick-pay) may have problem with retrieving the overpaid amount from the employee. One should remember that if the overpayment was due to the employer’s fault, e.g. as a consequence of incorrect determination of the allowance period, the employee may not be obliged to return such allowance, and there also will be arrears on the side of the employer towards the Social Insurance Institution.
